Terms and Conditions
01. Application
1.1 The following Terms & Conditions apply to all offers, contracts and other agreements made between Katie McDowell of Poppet Interiors (hereafter: “Katie McDowell”) and the client.
1.2 The terms & conditions of the client are not applicable.
02. Meeting and Proposal
2.1 The initial consultation meeting with the client will be free of charge.
2.2 Consultation meetings thereafter will be charged at a rate of £35 an hour.
2.3 A written proposal for the project is created free of charge.
2.4 The proposal will include a description of the project, the results, the design process and design fees. The proposal may also include project management fees, travel and accommodation fees.
2.5 A proposal from Katie McDowell is valid for 2 weeks after the date it was created. Confirmation of this proposal is expected in writing from the client within this timeframe, should they wish to proceed.
03. Contract
3.1 The contract refers to the description of the assignment in the proposal.
3.2 If the content, scope or desired result of the assignment changes during the design process, an additional agreement needs to be made or the assignment will be terminated (see 7. Early Termination) and a new contract will be proposed.
04. Project Execution
4.1 Should the client wish to make significant changes to the design after it has been signed off, in a way that does not align with the original creative brief, the costs of these changes will be charged at a fee relative to the work required.
4.2 The client agrees to provide feedback on all creative work within a reasonable time frame (usually five working days).
4.3 Should the client be unable to provide feedback on the project, approvals on design aspects or payments, and is late by more than 10 working days, the project will be considered to be on hold. Once the client is in a position to move forward, the project will be rescheduled based on the current workload and availability of Katie McDowell.
4.4 In the event of any changes the client wishes to make after a completed design and agreed contract, the client has two weeks to inform Katie McDowell in writing.
4.5 If the client reports this later, the costs of any additional changes will be charged to the client.
05. Intellectual Property
5.1 Katie McDowell is the holder of all intellectual property rights for the works created, including copyright.
06. Payment and Advance
6.1 Invoices sent by Katie McDowell will need to be paid within 10 working days.
6.2 If the payment is not received within 10 working days, additional administration costs may be charged.
6.3 To confirm acceptance of the design proposal, the client pays a non-refundable fee, as described in the design proposal.
6.4 The remainder of the design fee and project management fees will be invoiced in pre-agreed stages as the design work is completed.
6.5 Payment for materials, furniture or other items relating to the agreed design schemes will be invoiced prior to orders being placed.
No orders will be placed before payment for such items is received. If the client wishes to purchase the items independently, Katie McDowell cannot be held responsible for the delivery of these items, faults or damages, or the warranty of the product (commonly associated with appliances).
6.6 The final payment for the design will be due upon completion. This excludes a project management fee set out in the design proposal, pre-agreed with the client.
6.7 Any design work that extends beyond the original brief will be charged at an hourly rate of £45.
07. Design Charges
7.1 Kitchen design fees start from £350 and will depend on the size of the space and overall design, with consideration to include electrical and lighting plans, flooring suggestions, colour schemes, furniture and soft furnishings.
7.2 Bathroom design fees start from £275 and will depend on the size of the space and overall design, with consideration to include electrical and lighting plans, flooring suggestions, colour schemes, furniture and soft furnishings.
7.3 Other room fees will be dependent on the project requirements discussed with the client and set out in the design proposal.
08. Anomolies
8.1 Katie McDowell will advise an anomaly fee for the project, that may be required in the event of unexpected price increases on items, delivery fees, product changes that may carry a higher price to that of the original item suggested for the design, or unexpected faults and breakages that may occur as a result of work carried out by tradesmen, delivery drivers or suppliers.
8.2 Katie McDowell is not liable for any of that listed in 8.1.
09. Early Termination
9.1 In case the assignment is terminated by the client before completion, the client will pay a fee of 75% of the total costs, to compensate for the design work already completed.
10. Liability
10.1 Katie McDowell is not liable for errors and mistakes in the materials or information supplied by the client or third parties.
10.2 Katie McDowell is not liable for any damages that result from the use of her design, should the client seek alternative ways to deliver the project independently.
10.3 Any liability of Katie McDowell is limited to the proposed contract agreed and total fee invoiced for the project concerned.
11. Disputes
11.1 Common Law is applicable to all agreements made between Katie McDowell and the client.
11.2 In case of any disputes between Katie McDowell and the client, the Common Law courts of Great Britain has exclusive competence.
